Does my son’s daycare have to retain video footage from their surveillance cameras?

I’m evaluating several daycares for my son and the one that I really like told me that they don’t archive the video footage that they take from their surveillance cameras. I think that it’s great that they provide a way for me to check in on my son when I’m at work, but I’m worried that if something were to happen I wouldn’t be able get a ‘copy’ of the incident.

Are daycares required by law to keep archive footage from their cameras?

They are not required to archive them here in OR. In fact they do not even have to record them at all. I think it may depend on the state you are in.
